These Terms of Service govern access to and use of the VisitorCast website, presentations, accounts and software service.
By accessing or using VisitorCast, you agree to these Terms on behalf of the business or organisation you represent. You confirm that you are at least 18 years old and authorised to accept these Terms.
VisitorCast is intended only for businesses and professional users. It is not offered to consumers.

VisitorCast forecasts museum visitor numbers and analyses factors that may influence attendance using customer-provided and external data.
The service may include:
- Visitor forecasts for periods including 7, 30 and 90 days
- Historical analysis
- Analysis of attendance drivers
- Uploading visitor, exhibition and event data
- User and museum administration
- Reports and exports
VisitorCast is currently a beta service. Features may be changed, improved, added or removed as the service develops.
2. Agreement and order of precedence
These Terms apply to the VisitorCast website, presentations, subscriptions and use of the service.
A separate order form, subscription agreement, pilot agreement or other written contract may apply. If such an agreement conflicts with these Terms, the separate written agreement takes precedence.
3. Accounts
VisitorCast creates customer accounts, and customers may invite multiple authorised employees.
Each user must have an individual account. Accounts may not be shared.
The customer is responsible for:
- Ensuring that its users are authorised
- Keeping account and authentication details secure
- Removing access when a user no longer requires it
- Activity carried out through its accounts
- Providing accurate and current account information
The customer must notify VisitorCast promptly if it suspects unauthorised access or misuse.
VisitorCast may suspend access where reasonably necessary because of suspected misuse, security risks, illegal activity or overdue payments.
4. Right to use the service
Subject to payment of applicable fees and compliance with these Terms, VisitorCast grants the customer a limited, non-exclusive, non-transferable and non-sublicensable right to use the service for its own internal business purposes during the subscription period.
No ownership rights in VisitorCast are transferred to the customer.
5. Forecasts and customer decisions
VisitorCast forecasts and analyses are estimates based on available data, assumptions and statistical methods. They may be incomplete, delayed or inaccurate.
VisitorCast does not guarantee:
- Any particular visitor number
- The accuracy of a forecast
- That all relevant attendance factors have been identified
- That external data is complete or correct
- Any particular operational or financial result
The customer remains responsible for all decisions made using VisitorCast, including decisions concerning staffing, opening hours, ticket sales, budgets, marketing and museum operations.
VisitorCast must not be used as the sole basis for safety-critical, emergency, legal or regulated decisions.
To the extent permitted by law, Jakobam is not responsible for losses resulting from decisions made in reliance on forecasts, reports or analyses generated by VisitorCast.
6. Customer data
The customer retains ownership of data it uploads to VisitorCast.
The customer grants Jakobam the right to host, store, copy, process and analyse customer data only as necessary to provide, operate, secure and support the service.
The customer confirms that:
- It has the necessary rights to provide the data
- The data is lawful and reasonably accurate
- The data does not contain malware or harmful content
- The data does not contain personal data about individual museum visitors
VisitorCast is intended for aggregated visitor numbers and information about museums, exhibitions and events. Customers must not upload names, email addresses, membership identifiers, ticket identifiers or other data that identifies individual museum visitors.
VisitorCast may reject, restrict or delete data that is unlawful, harmful, technically incompatible or outside the agreed use of the service.
Jakobam may create anonymised and aggregated statistics about service use, performance and reliability, provided that no customer, museum or individual can be identified.
7. External data and third-party services
VisitorCast may use external data, including information about weather, holidays, school vacations, exhibitions and events.
Jakobam does not guarantee that external data is accurate, current, complete or continuously available.
VisitorCast may use subcontractors and service providers for hosting, authentication, communication, payments and other operational purposes.
The service may also integrate with third-party products or APIs. Jakobam is not responsible for the availability, accuracy, security, changes or discontinuation of third-party services outside its reasonable control.
The processing of personal data is described in the VisitorCast Privacy Policy.
8. Acceptable use
Customers and users must not:
- Use VisitorCast unlawfully or fraudulently
- Attempt to gain unauthorised access to the service or other accounts
- Interfere with or disrupt the service
- Upload malware or harmful code
- Scrape, crawl or systematically extract data without permission
- Reverse engineer, decompile or attempt to discover the source code or underlying models
- Share accounts or access outside the customer’s organisation
- Resell, sublicense or commercially exploit VisitorCast without written permission
- Use VisitorCast to develop or train a competing product
- Use automated tools or APIs unless explicitly authorised by Jakobam
- Circumvent usage limits, security controls or technical restrictions
Jakobam may investigate suspected misuse and may suspend or terminate access where reasonably necessary.
9. Subscriptions and payment
VisitorCast is normally provided as a monthly subscription that renews automatically until terminated.
Current prices may be published on the VisitorCast website or stated in a separate agreement. Unless otherwise stated, prices exclude VAT and other applicable taxes.
Invoices are payable within 14 days.
Payments are non-refundable except where required by law or expressly agreed otherwise.
For overdue payments, Jakobam may:
- Charge interest and reasonable recovery costs as permitted by law
- Suspend access to the service
- Terminate the subscription after reasonable notice
Jakobam may change subscription prices by giving at least three months’ notice. A price change will take effect at the beginning of a subsequent subscription period.
10. Trials and pilots
VisitorCast may offer demonstrations, trials or pilot services.
Separate conditions may apply to a trial or pilot. Unless otherwise agreed in writing, access to a demonstration does not create a right to continued access to the service.
11. Availability, support and maintenance
VisitorCast is provided on an “as available” basis.
Jakobam does not guarantee that the service will be uninterrupted, error-free or available at any particular time. No uptime commitment applies unless agreed separately in writing.
Support is available through support@visitorcast.com. No guaranteed support hours or response times apply unless agreed separately.
Jakobam may perform maintenance, updates and security work that temporarily limits access to the service.
Jakobam is not responsible for delays or failures caused by circumstances outside its reasonable control, including internet failures, hosting or cloud-provider outages, cyberattacks, labour disputes, natural disasters, government actions and failures of third-party systems.
12. Intellectual property
Jakobam retains all rights in and to:
- The VisitorCast software
- Forecasting models and methods
- Algorithms and technical processes
- Website and user-interface design
- Documentation
- Trademarks and branding
- Improvements, updates and new features
The customer retains ownership of its underlying data.
The customer may use and export reports, charts and forecasts generated from its data for its own internal business purposes.
Feedback, suggestions and ideas provided to VisitorCast may be used by Jakobam to improve or develop the service without payment or restriction.
13. Confidentiality
Each party must protect confidential information received from the other party and must use it only for the purposes of the business relationship.
Confidential information does not include information that:
- Is publicly available without a breach of these Terms
- Was already lawfully known to the receiving party
- Is received lawfully from another source
- Is independently developed without using the other party’s confidential information
- Must be disclosed by law or a competent authority
Jakobam will not publicly use a customer’s name, trademark or logo as a customer reference without prior permission.
14. Data export and deletion
Customers may export available customer data before the subscription ends.
After termination:
- Access to VisitorCast will end
- Outstanding invoices remain payable
- Customer data will normally be deleted within 30 days
- Deleted data may remain temporarily in backups
- Information may be retained where required by law
The customer should complete any required exports before access ends.
15. Termination
Subscriptions run monthly and may be terminated by either party with 14 days’ notice.
Either party may terminate the agreement for a material breach if the breach is not corrected within 14 days after written notice.
Jakobam may suspend or terminate access immediately where reasonably necessary because of:
- Illegal or fraudulent use
- A material security threat
- Serious misuse of the service
- Repeated or significant breaches of these Terms
- Overdue payment
Termination does not affect rights or obligations that arose before termination.
16. Warranties
To the extent permitted by law, VisitorCast is provided without warranties concerning:
- Accuracy
- Availability
- Fitness for a particular purpose
- Error-free operation
- Compatibility with all systems
- Achievement of specific business results
Nothing in these Terms limits warranties or rights that cannot legally be excluded.
17. Limitation of liability
To the maximum extent permitted by law, Jakobam is not liable for indirect or consequential losses, including:
- Lost profits
- Lost revenue
- Lost savings
- Business interruption
- Loss of opportunity
- Loss or corruption of data
- Consequential or special damages
Jakobam’s total aggregate liability arising from or relating to VisitorCast is limited to the subscription fees paid by the customer during the three months immediately preceding the event giving rise to the claim.
The limitation does not apply where liability cannot legally be limited, including liability arising from intentional misconduct.
18. Changes to the service and Terms
Jakobam may update VisitorCast and these Terms from time to time.
Material changes to the Terms will normally be communicated at least 30 days before they take effect.
Continued use of VisitorCast after the effective date of updated Terms constitutes acceptance of those Terms. If the customer does not accept a material change, it may terminate its subscription before the change takes effect.
19. Governing law and disputes
These Terms are governed by Danish law, without regard to conflict-of-law principles.
The parties will first attempt to resolve any dispute through good-faith negotiation.
If a dispute cannot be resolved through negotiation, it will be submitted to the City Court of Copenhagen as the court of first instance, unless mandatory law requires otherwise.
